Wife reveals Muthama’s soft underbelly at police station

Machakos Senator Johnston Muthama’s wife broke down as she watched her husband being ushered into the Directorate of Criminal Investigations (DCI) offices for grilling over alleged hate-speech.

Jemima Muthama, clad in a red dress and a white blazer, accompanied her husband to the criminal investigations headquarters on Kiambu Road Tuesday morning and was overcome by emotions after watching her husband being ‘man-handled’ by flying squad officers.

The officers had gone to their home in Runda to pick the Senator, after Inspector General of Police Joseph Boinnet issued orders that they should appear for grilling at the DCI headquarters.

‘MISTREATED’

When finally the vehicles carrying Mr Muthama and the officers from the squad arrived at the DCI’s gate, Mrs Muthama and his body guards were asked to disembark from the vehicles as only the Senator would be allowed into the offices to record statements.

Mrs Muthama could not hold back her tears and she kept wiping her face as her husband’s bodyguard and other politicians pleaded with the police to allow a few members of the family to accompany the senator.

She was allowed into the car and sat on the right side of her husband who kept claiming that the police had mistreated him.

Kenyan woman wows Michelle Obama at White House – VIDEO

A Kenyan woman got 15 seconds of fame after she was honoured by US First Lady Michelle Obama at an exclusive event held at the White House on Tuesday.

The woman, Wanjiru “Ciru” Waithaka, runs a company called Fun Kidz that creates “furniture, accessories and educational tools for children, that are based on African stories”.

Mrs Obama cited Ciru as an example for women who are empowering others in her society, while two others were speakers at an important summit for women.

“You go girl! Ciru is from Kenya so we’re family,” said an evidently elated Mrs Obama sending guests into a fit of laughter.

For starters, her husband and US president Barack Obama is son of a Kenyan father.

TRADEMARK HUG

The First Lady made the remarks during the United State of Women Dinner which was held on Tuesday, June 14 as part of the White House United State of Women Summit, at the US Department of State.

She interrupted her sentiments about Ciru to blow kisses at the awestruck Kenyan woman who was in the audience. At some point, Mrs Obama summoned her to the stage, declaring: “This is worth stopping for a second,” she said.

She then wrapped her hands around her for her trademark hug. Mrs Obama says Ciru got a loan from Goldman Sachs 10,000 Women, a global initiative that fosters economic growth by providing women entrepreneurs around the world with a business and management education, mentoring and networking, and access to capital.

“This helped her double her production, where as she couldn’t keep up to supply to the demand before, double her staff and reach a global market,” said the First Lady.

Ciru later then formed a program for children from needy families that has touched more than 350 children in teaching them about innovation and technology.

Bungoma chopper man immortalized in a video game

The Bungoma man who rose to fame after hanging on a moving chopper has now been immortalized in a video game.

Mr Saleh Wanjala had hanged on a chopper that had delivered the body of slain businessman Jacob Juma as it flew away from Bungoma’s Posta grounds in May.

A video game making company, Awesome Graphics and Mesmerize Games, has now released a video game version of the incident.

Dubbed Bungoma Hangman, the game takes users on a similar stunt of hanging on a helicopter’s tabular landing skids like Mr Wanjala. The game was released earlier this week.

Users accumulate points the longer they hang onto the chopper while avoiding airborne objects that could halt the ride like birds.

Users can boost their strength to hang longer by crashing into foods like a plate of ugali, a bunch of sukumawiki or a piece of chicken.

“Join the Bungoma Hangman in his epic adventure as he pulls the biggest stunt in Kenya. How far can you go without crashing?” the games tag line reads.

The game is available for android users on Google Playstore.

Cord leaders denied access to MPs detained at Pangani station – PHOTOS

Cord principals were on Thursday denied access to visit the legislators locked up at the Pangani Police Station.

Principals Raila Odinga, Moses Wetangula and Kalonzo Musyoka arrived at the station mid-morning but were not allowed to talk to their six colleagues held in the police cells.

Machakos Senator Johnson Muthama, MPs Moses Kuria (Gatundu South) Junet Mohammed (Suna East), Ferdinand Waititu (Kabete), Timothy Bosire (Kitutu Masaba) and Kimani Ngunjiri (Bahati) are being held at Pangani Police Station over hate speech charges.

Homa Bay Women Rep Gladys Wanga told journalists outside the police station of their frustration at not meeting their colleagues.

“They (the Cord principals) have been kept waiting in another room yet they have a right to visit the suspects”, she said.

Nairobi Governor Dr Evans Kidero, Mombasa Senator Hassan Omar and Siaya Senator James Orengo are also at the station.

Relatives of the six politicians camped at the police station from Thursday morning to demand to be allowed to see the suspects.

A heavy contingent of anti-riot police has been deployed inside the compound.

Esther Muthama, a sister to Senator Muthama, said they had been stopped from visiting him or offering him food.

“We cannot give him warm clothing because we have been barred,,” she told journalists outside the police station.

Ms Wanga said one of the female MPs locked up at Muthaiga was unwell. She said the Cord leaders will head to Muthaiga afterwards.

Jubilee legislators were however a no show Thursday but spouses of detained Jubilee MPs were at the police station.

Mombasa court declares anal tests for homosexuals legal

The High Court in Mombasa has dismissed a petition by two suspected homosexuals challenging the constitutionality of undergoing an anal examination as proof of being gay.

High court judge Justice Anyara Emukule dismissed the petition on grounds that it had no merit since the petitioners had consented to the test

“The medical examination of the petitioners and the taking of samples was in accord with the applicable law, I find no violation of the petitioners’ rights as contended in the petition, it therefore has no merit and dismissed,” Justice Emukule ruled.

“The record of proceedings is instructive that the petitioners did not object nor did they protest the test. It is clear to me that the petitioners willingly and voluntarily consented the medical examination,” he added

Justice Emukule said the petitioners were ably presented by their lawyers and if they had any difficulty of consent they were at liberty to stay all the proceedings and appeal against such orders.

Mr Caleb Omar Idris and Mr George Maina Njeri had applied to the court to dismiss evidence the prosecution obtained from them claiming it was acquired illegally.

VIOLATION OF HUMAN RIGHTS

The two applied in a petition that evidence were obtained against the principle of self-incrimination by the accused persons as provided for under the constitution and the law of evidence.

Through their lawyer, Ligunya Sande, the two argued that they were forced to have anal medical examination on consequential HIV and Hepatitis B testing, which they claimed subjected them to torture, cruel, inhuman and degrading treatment and or punishment.

The lawyer had urged Justice Emukule to consider the petition with regard to international, regional and domestic human right laws as well as the provisions of the Kenyan constitution on medical examination conducted without one’s permission.

The petitioners had urged the court to declare the manner in which the forceful and coercive medical examination was conducted unconstitutional and throw the evidence out of their case.

They further argued that such procedures and tests violate human right to privacy whether they are done to help police.

Babu Owino charged with incitement

Students Organisation of Nairobi University chairman Paul Ongili, alias Babu Owino, was on Thursday charged with incitement.

He is alleged to have uttered words to the effect that Gatundu South MP Moses Kuria and his Bahati counterpart Kimani Ngunjiri would “face dire consequences” over anti-Raila Odinga remarks.

Mr Owino is alleged to have made the statement during a press conference at Orange House on June 13.

The prosecution objected to his release on bond.

The magistrate will rule on the bond application in the afternoon.

Raila demands release of Moses Kuria and seven other detained MPs

Cord leader Raila Odinga has demanded the release of the six MPs held at Pangani police station within the next 24 hours failing which he warned that there would be consequences.

Mr Odinga said Cord will would a comprehensive statement later in the afternoon specifying the “consequences”.

The Cord leader made the threats outside Pangani police station where he had gone to visit three MPs Cord MPs who are in custody alongside three others from Jubilee.

HATE SPEECH CHARGES

Machakos Senator Johnson Muthama (Cord), MPs Moses Kuria (Gatundu South, Jubilee) Junet Mohammed (Suna East, Cord), Ferdinand Waititu (Kabete, Jubilee), Timothy Bosire (Kitutu Masaba, Cord) and Kimani Ngunjiri (Bahati, Jubilee) are being held at Pangani Police Station over hate speech charges.

Aisha Jumwa (Kilifi women rep, Cord) and Florence Mutua (Busia women rep, Cord) are held at Muthaiga police station.

By demanding a blanket release of all the six MPs, the Cord leader departs from an earlier position where the opposition had demanded for a release of just the five Cord MPs.

It is also important to note that Mr Kuria is in custody for remarks he made implying that someone could kill the former Prime Minister and blame it on him.

Mr Odinga accompanied by Cord principals Moses Wetangula and Kalonzo Musyoka and Mombasa Governor Hassan Joho later visited the two female MPs at Muthaiga where they were allowed to meet them at the OCS’s office.

Meanwhile, trial Court is right to deny eight legislators bail, High Court has ruled.

SERIOUS CHARGES

In his ruling stating reasons why he dismissed the application to be released on bail pending their trial on Friday, Justice Joseph Onguto says their charges are regarded as very serious.

He also has said that since both lawyer’s for the legislators and the state have admitted before him that they detainees conditions were looked after their plight was told to the Court on Wednesday , it would be right for them to appeal for their release to the trial court that orders for their detention to be lifted.

At the same time, lawyers John Khaminwa and Harun Ndumbi have pleaded with the judge over their release.
They told court that the conditions in cells is deplorable and that some of them who takes regular medication have been subjected to inhumane treatment.

But the judge declined to issue any orders regarding their requests saying that he was only required to give his reasons for dismissing their application before delivering this ruling.

Nairobi MCAs threaten to reject Kidero’s Sh36 billion budget

Nairobi County Assembly members have vowed not to pass this year’s budget, accusing the executive of withholding Ward Development funds.

The standoff threatens to bring services in the city to a halt if the MCAs do not approve the Sh35.89bn 2016/2017 budget whose deadline is June 30th 2016.

The Ward Development fund has been allocated Sh1.6 billion in the 2016/2017 budget which will enable the Members of the County Assemblies (MCAs) implement projects in their wards.

GIVE AN ACCOUNT

The County Assembly Speaker Alex Ole Magelo said the executive should give an account of the ward development funds set aside every financial year and how the money has been spent. He said the assembly has never approved a bill supporting expenditure of the funds.

Majority Leader Elias Otieno told the assembly that the executive has been using them by promising goodies during the budget period that are never fulfilled.

“Some people are lured with goodies, including promises of pieces of land, to pass the budget year in year out and the executive fails you and you end up with nothing. Therefore the Speaker should not bring the budget to the assembly,” said Mr Otieno.

Mr Magelo has also blamed the executive for not releasing funds to the assembly promptly especially gratuity and development monies.

The Speaker directed the Budget and Appropriation Committee to table the amendments to the Ward Development Fund Bill by Tuesday next week .

He added that the executive has been allocating funds to projects which are never implemented by the end of every financial year.

Policeman, ex-con arrested over series of robberies in Nairobi

A police officer and an ex-death row convict who won an appeal six months ago were on Thursday arrested in Nairobi for a series of robberies.

Constable Timothy Wainaina, who is attached to the Anti-Stock Theft Unit (ASTU) Gilgil Mounting Company, together with Mr Reuben Chege Mburu were arrested near Nation Centre after being trailed for hours from Mirera estate in Ruiru.

The detectives led by the Ruiru Directorate of Criminal Investigations (DCI) boss David Chebii also arrested Mr Bernard Mwangi, one of the five-man gang, during the operation.

SIX ROBBERY INCIDENTS

The three, police said, were linked to at least six robbery incidents within Ruiru and adjacent areas in the last few weeks and several others in Nairobi.

When they were arrested, police recovered from them two previously robbed mobile phones and Sh25, 000.

On Wednesday night, detectives from Ruiru also raided a residence in Githurai where the gang allegedly keeps their firearms but two of them escaped the dragnet.

The officer in charge of the Karuri Flying Squad is also investigating incidents that the gang is believed to have involved in.

Police described Mr Mburu as a notorious robber who had been linked to several robbery incidents since January this year when the High Court quashed the death sentences and released him and his co-accused.

ROBBING MATATU CREW

The two had been accused of violently robbing a matatu crew and passengers of property worth Sh2 million on January 25, 2011, on Limuru Road in Nairobi armed with pistols.

According to the court files, they had robbed Mr Peter Migwi Kagiri of his Nissan matatu registration number KBH 504X valued at Sh1.15million, a mobile phone and Sh1, 000, while armed with pistols.

They also robbed Mr Jackson Obote Ongo, Mr James Muturi Ndegwa, Mr Daniel Njuguna Gitau, Mr Bob Onyango Ouko, Ms Sarah Wangui Gicharu, and Mr Moses Wachira Kimani.

Other victims were identified as Mr Joseph Musyoka Msee, Mr Charles Oluchili Tete and Ms Agnes Njeri Gichuhi.

The following day, Mr Mburu was arrested with five mobile phones while his co-accused was arrested in Gathongora Area in Ruiru with one sub-woofer speaker and an equalizer that had been stolen from the matatu. He was also found with two mobile phones.

Superintendent of Police, Henry Kiambati conducted the identification parade at Gigiri police station.

POSITIVELY IDENTIFIED

The witnesses Agnes Njeri, Charles Oluchili Otete and Joseph Irungu positively identified Mr Mburu as the one who brandished the gun. The victim’s phone was also found with Mr Mburu.

The conductor, Mr Joseph Irungu, later identified the second accused person at the Ruiru police station. He had spoken to him before they boarded the matatu.

After the case, they were found guilty and convicted of nine counts and sent to the gallows. They, however, appealed at the High Court and won.

The judge concluded that the sentence imposed “was manifestly excessive in the circumstances” and that the identification parade rules were faulted.

Also, it was said that the two were only convicted on the basis of the doctrine of recent possession, in that they were found with the items which the passengers had been robbed of.

Man Photoshops self in London in copycat stunt

A day after Seve Gats – the girl who edited herself into photos of tourist attraction sites in China – arrived in Beijing, another Kenyan has posted a Photoshop picture of himself outside the United Kingdom Parliament.

Gathungu wa Gathoni shared an edited photo of him squatting on a London bridge with the UK parliament on the background on his Facebook page.

The copycat stunt has been widely rebuked as ‘an effort to attract a sponsor’ for a trip to London.

Seve Gats, real name Seveline Kinya, became an instant internet sensation after she shared dozens of poorly edited photos claiming to have left the country for China.

Nailab founder Sam Gichuru came to Gats’ rescue and raised enough money for her to go on holiday in China.

She is presently in China to visit the tourist sites she had edited herself into.

Industry Nite to kick off a countrywide tour

The annual Industry Nite, that brings together established and upcoming artist under one roof, will this year be celebrated across the country.

Starting on Saturday June 18, the Industry Nite will embark on a five county tour that will kick off in Machakos with live performances by various artistes at Club Euphoria.

According to the organizers, revelers will be treated to good music, food and drink at no costs at all.

GUEST ARTISTES

Among the artistes expected to perform will be Khaligraph Jones and Vivian, C2K, TOTT (Talk of the town), Scalle, Wesley Tides and K the Rapper.

From Machakos, the tour will proceed to Meru (Venus – June 25), Nakuru (Club 64 – July 2) followed by Kisumu at a yet to announced venue on July 9. Sheba Lounge in Mombasa will be the final stop in the tour on July 16.

The tour will incorporate concerts and workshops, with the latter being held during the day.

Cord now calls fresh demonstrations starting Monday if all MPs being held by police over hate speech are not released unconditionally by end of business on Friday.

The opposition leaders led by Raila Odinga and Kalonzo Musyoka have also announced they will lead supporters into a major rally in Machakos on Saturday to honour the “detained” MPs.

Ugandan soldier goes bonkers, kills eight at barracks

A Ugandan soldier was on Thursday afternoon shot dead by his colleague moments after he had killed eight people at a barracks.

According to media reports, Sgt Obua Isaac opened fire at Makindye Barracks upon learning he was about to be arrested in a swoop targeting disloyal military officers.

He is reported to have killed at least eight people at the Makindye Barracks, including his colleagues’ family members – all of whom are women and children.

That was before he was overpowered and shot dead by fellow military officers. The Barracks has since been cordoned off.

SHOOTOUT

These development comes barely a week after another shootout occurred at a Police station in Gulu, northern Uganda, where a police officer was killed in a shootout.

The particular exchange of fire in Gulu was reportedly necessitated by a group of armed people out to rescue their arrested colleagues at the station.

All this happens at a time Uganda’s main opposition leader Kiiza Besigye is facing trial for treason.

Besigye, 60, was arrested on May 11 – on the day a video of him being “sworn in” as the country’s President went viral on social media.

Sniffer dog blamed for bomb scare at Canadian High Commission

A sniffer dog on Thursday raised a false alarm when parcels were being delivered to the Canadian High Commission in Gigiri, Nairobi, causing a four-hour lockdown.

According to police, a FedEx van was delivering visa application documents when the G4S dog barked after sniffing on the van, indicating it had detected something suspicious.

This caused panic and fear in the complex.

ROAD BLOCKED

Immediately after the alarm, extra security checks were put in place and the section of Limuru road between Muthaiga mini-market roundabout and the UN Avenue was blocked for hours by General Service Unit officers and detectives.

Embassy personnel were evacuated and told to stay away.

Those who had not reported to work were to remain at home.

“The Canadian High Commission is currently off-limits. All core business staff, locally engaged staff and spouses not at the High Commission are to remain at home. Update to follow,” the alert read.

Traffic police officers diverted vehicles to other roads. A bomb disposal team from the Directorate of the Criminal Investigations arrived at the embassy to inspect the suspicious packages.

The team was later joined by the acting Commandant Diplomatic Police Unit Ambrose Mwawaka, Gigiri OCPD Vitalis Otieno and his DCI counterpart Daniel Kandie.

DECLARED SAFE

Around 11.40am, Inspector-General of Police Joseph Boinnet declared the place safe. Mr Boinnet said the 35-kilogramme parcel contained visa forms and that the bomb disposal unit team of Mr Eliud Langat, had declared the cargo and the area safe.

The embassy is guarded by the GSU officers but has contracted the KK Security company to man the gates and screening machines but replaced them with G4S a few months ago.

The G4S officers are usually accompanied by a number of dogs.

The company’s communication officer Yvette Miyoma did not respond to questions from the Nation.

The heavily-guarded embassy borders Kenya Technical Teachers College and the Rwandan embassy.

The legislators could be slapped with additional and more concrete charges when they appear in court, according to the National Cohesion and Integration Commission.

NCIC chairman Francis ole Kaparo has said the body would also “vehemently” oppose bail for the MPs, who have since Tuesday been in custody, with a magistrate and a judge refusing to grant them bail.

One of the legislators set to be charged with incitement fell sick in the courtroom on Friday morning.

Court proceedings had to be temporarily halted after lawyer Michael Osundwa explained that Bahati MP Kimani Ngunjiri needed medical attention.

“He is feeling dizzy and could vomit,” lawyer Osundwa told the court.

Immediately, Kakamega Senator Boni Khalwale moved from his seat where he was following the proceedings and went to assist the visibly sick legislator.

Senator Khalwale, who is a medical doctor, helped Ngunjiri unbutton his light blue shirt and thereafter led him out before the court proceedings continued amid murmurs.

MP Ngunjiri later returned to the courtroom where he denied the charges of hate speech and incitement to violence.

Leopards’ fans to wait much longer for club elections

AFC Leopards Electoral Board has announced that the club’s eagerly awaited national elections have been rescheduled by “a couple of weeks”.

The announcement however drew mixed reactions from the club’s supporters and branch officials, who accused the club’s current interim officials and Sports Tribunal of dillydallying on this process.

The club’s Electoral Board Secretary General Irene Tindi had last week announced that the exercise which had delayed for six months, will be held in Nairobi On July 3.

She however revised her stance last week, while attributing the delay to the unavailability of the membership register.

“We are yet to receive the voter register which is very crucial to this (elections) exercise. It is also mandatory to verify this register and put together the modality of how to manage the process,” Tindi said.

POOR PERFORMANCE

Club fans on their part are claiming the uncertainty in leadership was the cause of the team’s poor performance during the first leg of the current Kenyan Premier League season.

“We are concerned with this deliberate effort by some club officials and members of the Sports Tribunal to treat this sensitive issue in a casual manner. The current officials of the club are not even elected and their temporary mandate (of 120 days) handed to them last December has lapsed. We are demanding for elections on July 3,” Ronald Namai, who is the fans’ coordinator declared.

The club is currently led by co-chairmen Matthews Opwora and Dan Mule who took the helm on an interim basis last December, following the abrupt resignation of former chairman Allan Kasavuli in May last year.

Leopards have only won five of the 15 league matches this season, and are currently placed 11th on the 16-team, seven points above the relegation zone.
