Former Independent Electoral and Boundaries Commission (IEBC) commissioner Roselyn Akombe has reacted to a press conference held by Gatundu South MP Moses Kuria over the murder of the electoral agency’s ICT boss Chris Msando.

Ms Akombe took to social media and stated Kenyans were not satisfied with what Mr Kuria had said about the murder and it was time justice prevailed.

Addressing the media in Parliament, Mr Kuria, who is serving a second term, threatened to sue anyone who linked him to the death of Mr Msando. But Ms Akombe does not agree with the legislator.

“To #moseskuria and your buddies: ‘No, no, we are not satisfied, and we will not be satisfied until justice rolls down like waters and righteousness like a mighty stream’,” she posted on her official Twitter account.

Mr Kuria, in a Facebook post last week, had threatened to spill beans over what really transpired and led to the death of Mr Msando.

However, his press conference focused more on the Building Bridges Initiative (BBI) and he said that the government should stop intimidating other law makers.

Mr Msando was murdered in July 2018 and his death was linked to Mr Kuria after he took a photo of the deceased’s vehicle.

Boniface Mwangi blocks another ‘VIP’ vehicle driven on wrong side – VIDEO

Activist and photojournalist Boniface Mwangi was on Tuesday morning hailed as a hero after he recorded and shared a video of himself, yet again, refusing to give way to a VIP motorcade that being driven on the wrong side.

In the video, the three-vehicle convoy is seen being driven toward oncoming traffic along Lang’ata Road.

The VIP being driven in a Toyota Prado, registration number GKB 970R, was being escorted by three vehicles including a police car.

Speaking to Nairobi News on phone, Mwangi advised motorists to stay put but make sure they lock their vehicles during such a confirmation.

“Legally, you’re not breaking any law and you can’t be arrested. The best way to be safe, is to always lock your doors, and if possible record everything. You lock the doors because Kenya police officers behave like criminals, they can snatch your car keys, phone or even assault you. It’s not worth taking that risk. Lock your car, roll your windows up, stay put and record their impunity,” advised Mwangi.

DAMAGED

“In case your vehicle is damaged during the confrontation with the security detail of the VIPs, Mwangi advices one not to leave the scene and make sure you record everything during the  incident. First time you do it, it’s scary, VIP cops are bullies but they can’t touch you. In case they damage your car, they will flee the scene of crime, don’t leave, wait for the traffic police to arrive.”

According to Mwangi, road users should only give way to emergency vehicles including fire engines and ambulances.

“If the officer is breaking the law, by driving on the wrong side and it’s not an emergency, you have a moral and legal right to defy him. The police aren’t the law, the law is the law,” he said.

He further asked Kenyans to play their part in the fight against impunity.

“We must fight the impunity in our country by doing the little things we can. You refusing to give way to an entitled VIP on the wrong side of the road is your act of courage. One day we shall win. Keep On,” he added.

This is not the first time photographer-cum-activist has blocked a VIP motorcade.

Two suspected pickpockets allegedly found with a woman’s purse, phone and money after stealing from her at Drive Inn stage on Thika Super Highway were Friday charged before Makadara law court with theft.

They are Daniel Gatei and Euticaus Maina Gatundu.

They are accused of stealing the items worth Sh 12,000 from Rhoda Njambi Kinuthia on January 14 as she crossed over from Mathare, to catch a matatu on her way to Murang’a.

Different persons

Gatei is facing two additional charges of handling suspected stolen property after he was allegedly found with an ATM card and and an ID belonging to different persons.

Gatundu was charged with possession of Sh 800 which he could not account for.

Kinuthia noticed that her purse, phone, money, and two national ID’s were missing from her handbag and remembered two men who were walking behind her as she crossed the busy highway.

She returned and reported to bodaboda operators at the stage and gave description of their dressing. The riders cornered the two.

The suspects were rescued by police before they were lynched after they were found with Kinuthia’s belongings. They denied all charges before chief magistrate Heston Nyaga.

Nyaga freed them on a cash bail of Sh10, 000 each. Hearing of the case starts on May 12.

The Directorate of Criminal Investigations is holding two youthful men who found with a mobile phone belonging to a businessman who was found murdered at his house in Kayole.

Dancun Kimeu Muthoka and Ian Kariuki are detained at Kayole police station as detectives look for a suspect who sold them the mobile phone.

Peter Mihunyo was found dead inside his house on December 26 with bodily injuries and his phone missing.

Muthoka was found with Mihunyo’s phone and he told detectives that his friend Kariuki approached him to buy the gadget, which was being sold by the missing suspect.

“We are still pursuing the one at large whom we highly suspect is the key suspect who will unearth what transpired as we are still processing his call data,” detective constable Victor Odhiambo of Kayole DCI offices said in application for custodial orders at Makadara law courts on Monday.

Odhiambo was seeking courts orders to detain the two for 14 days to assist in investigations into Mihunyo’s murder.

Mihunyo’s wife Emily Wangechi reported to police that she travelled to Nakuru on December 19 and left her husband in Nairobi and she did not receive any communication from him until December 25 when she decided to return to check on him the next day.

She found the door closed from inside and with help of neighbours, broke in only to find Mihunyo’s body lying on his bed. Senior resident magistrate Merissa Opondo allowed detention of Muthoka and Kariuki.

DCI, IPOA to probe death of senior traffic cop after Twitter exposé

The Independent Policing Oversight Authority (IPOA) and the Directorate of Criminal Investigations (DCI) have separately vowed to investigate the death of a senior traffic officer, Mr Alfred Ndalana.

Mr Ndalana died in July 2016 and his colleagues said he had committed suicide just hours after undergoing police vetting and answering tough questions.

However, his daughter Ndallana Mutheu raised fresh questions over the death of her father saying that the family was still suspicious on how everything was carried out.

DCI asked her to report the matter at their headquarters. “Kindly, visit the DCI Corporate Communications and Public Affairs office at the DCI Headquarters block office number 32,” the DCI told Ms Mutheu.

CONVENIENT TIME

On the other side, IPOA asked her to visit or contact them. She claims Mr Ndalana was murdered by his juniors who were working on orders from senior police officers.

“Later they addressed him and got rid of his body by dumping it at the Jaramogi Oginga Odinga mortuary, but none of the officers involved in the activity briefed the family about it,” Ms Mutheu said in a series of tweets.

Ms Mutheu also said that her mother, who runs a salon in Buruburu, was robbed of her money by armed gunmen and to date no action has been taken despite reporting the incident to the police.

According to her, she was also threatened by two men who followed her to university warning that they will deal with her.

The family claimed that it has never been issued with a postmortem report after the death of Mr Ndalana and the investigating officers took the family round in circles.

A bodaboda rider was Monday charged with violently robbing a policeman of his firearm after hijacking him while riding on the suspect’s motorbike in Kayole.

John Njoroge is accused of robbing constable Howard Kipkoech attached to Obama police post of his pistol loaded with 15 bullets on January on August 14 last year at 2am, jointly with others at large.

Njoroge is also facing charges of illegal possession of a firearm and ammunition after he was allegedly found with the pistol and two bullets in Naivasha, Nakuru County on January 1 without a license to possess them.

Kipkoech and his two colleagues were on official duties in the area when they encountered a bodaboda rider who suddenly stopped and abandoned the motorcycle.

The three officers agreed Kipkoech would ride the motorcycle to the post as they followed behind in a probox.

The officer was, however, ambushed by a man who jumped onto the pillion seat as he negotiated a bump and placed a pistol to his head.

Another passenger mounted the bike as the cop negotiated another bump and the two allegedly commandeered him. The officer, however, sped towards the post.

The passenger pushed him down and took his pistol before he disappeared.

Njoroge denied the charges before senior resident magistrate Merissa Opondo. He was freed on a surety bond of Sh1 million. Hearing of the case starts on May 13.

Did Sonko wear Sh100k t-shirt in court?

Nairobi Governor Mike Sonko on Tuesday set tongues wagging after he showed up in a Voi court with an exclusive ‘Versace Tribute’ t-shirt that is worth Sh99,000.

An original exclusive ‘Versace Tribute’ collection “Wild Baroque – SS 1992” retailed at between Sh75,000 ($750) to Sh99,000 ($995) which was a limited edititon at the time of launch in 2017. There are, however, other variations available online for As low as Sh5,000 ($50.)

During his dramatic arrest last month, the t-shirt which the embattled Governor wore was torn on the side and became a topic of discussion online because it was worth $531 which translates to Sh53,976, according to the current exchange rate. It was also from the Italian luxury fashion house Versace.

Sonko arrived in Voi, Taita-Taveta County, Tuesday morning where he was expected to face assault, resisting arrest and offensive conduct charges.

The Jubilee Governor, who is known for his trendy outfits, stood accused of assaulting Coast regional police commander Rashid Yakub, who has since dropped the charges.

CORRUPTION CASE

Sonko is currently restricted from accessing his office pending the conclusion of his corruption case.

The governor is facing a Sh357 million graft charge on money laundering, receiving bribes and conflict of interest.

Earlier this month, Sonko petitioned the court to open his accounts because he was unable to financially support himself or his family.

His remarks came after the Assets Recovery Agency (ARA) asked the court to freeze five of his accounts following claims of suspicious money transactions believed to be proceeds of crime “as a result of theft from Nairobi county government”.

The flashy governor, known for openly splashing millions and wearing costly and ostentatious bling, said he was financially grounded and that he could not support himself or his family and cannot even draw his salary as governor.

Last year during an interview, Sonko claimed that he was worth more than the county’s Sh38 billion annual budget.

Starehe Member of Parliament Charles Njagua alias Jaguar has applauded the move made by the prosecution to drop assault charges against Nairobi Governor Mike Sonko.

Sonko appeared in a Voi court on Tuesday morning to answer to charges of assaulting a police officer while resisting arrest.

However, the Coast regional police commander Rashid Yakub, the complainant, filed an application to drop the case against the governor saying that he is no longer interested in pursuing it.

Senior Resident Magistrate Frederick Nyakundi said he would rule on the matter on Wednesday.

“I welcome the move by the ODPP to withdraw assault charges against Nairobi Governor Mike Sonko. Sonko was unarmed, handcuffed, and surrounded by tens of police officers. It is inconceivable that he could have assaulted the officer under such circumstances unless provoked,” tweeted Jaguar.

Mr Sonko was intercepted by police in Voi last year in December. During his arrest, a scuffle ensued between him and the police officer before he was airlifted to Nairobi to answer to corruption charges.

The Kenya Urban Roads Authority (KURA) had urged motorists using the junction of Lower Kabete Road and Brookside drive in Nairobi to use alternative route since the area will be closed for two months due to ongoing road works.

Kura has urged motorists to use alternative routes starting January 28 until March 25, 2020 when the project will be completed.

The closure is due to the installation of a box culvert at the junction.

Motorists for Lower Kabete bound traffic have been urged to use Peponi road-Mwanzi road, while those for Brookside drive bound traffic via Mwanzi road will use Peponi road-Lower Kabete road-Brookside drive.

Those using Lower Kabete bound traffic from Brookside drive are advised to use Lower Kabete road-Peponi road-Mwanzi road.

Motorists using Mwanzi road from Brookside drive have been urged to use Lower Kabete-Peponi road.

The agency said the alternative provided shall be sufficient for motorists as they should follow instructions provided by traffic marshals.

Starehe Member of Parliament Jaguar appeared to mock his Embakasi East Counterpart Babu Owino’s who is remanded at the Industrial Area Prison in Nairobi.

Jaguar said he had donated more than 200 mattresses to Industrial Area Prison since he says those in prison awaiting ruling of their cases also deserve to sleep comfortably.

He directly mentioned implying at Mr Owino who is currently being held at the Prison.

“Today I will donate over 200 mattresses to Industrial Area Prison, Starehe. I believe that remandees should be as comfortable as possible as they await the outcome of their cases. My colleague, Hon. Babu Owino, will benefit from one of the heavy-duty mattresses,” wrote Jaguar. However, there were no heavy duty mattresses in the picture.

Mr Owino is accused of shooting Mr Felix Orinda alias DJ Evolve and critically injuring him. On Monday, Nairobi Chief Magistrate Francis Andayi remanded the youthful legislator until January 27 when the court will rule on whether he will be granted bail.

Babu and Jaguar share a love-hate relationship that has stemmed from their support for opposing candidates in the 2017 general election. While Jaguar supported President Uhuru Kenyatta, Owino backed ODM leader Raila Odinga. The two at one time exchanged blows in parliament due to their political differences.

FIGHTING HIM

Jaguar later apologised for his actions but an unapologetic Babu kept on his stance saying that he did not regret fighting the colleague.

After the scuffle in a show of solidarity with the Starehe MP, Owino showed up at Milimani Law Courts in June 2019 wearing a conical hat also known as an Asian rice hat.

At the time, Jaguar was facing charges of incitement over xenophobic remarks.

The Senate was on Tuesday evening forced to adjourn for 10 minutes to reconsider the list of the 11 members proposed to consider the impeachment of Kiambu Governor Ferdinand Waititu.

The adjournment was proposed by Leader of Minority James Orengo (Siaya) after Senators led by Samuel Poghisio (West Pokot) raised issues with the membership claiming that it was disproportionate in favor of Tangatanga wing of Jubilee.

Waititu is associated with Tangatanga and, therefore, a majority of Senators including Isaac Mwaura believe that the committee may not bring a fair report to the House.

Mwaura said that no Senator from Central Kenya was chosen to be a members the committee.

Waititu is facing charges of impropriety in road tendering in the county.

Bandari will come good, vows Muhiddin

Bandari caretaker coach Twahir Muhiddin is convinced that the team will overcome the poor form they currently are in and do better in upcoming matches.

The reigning Domestic Cup champions are having a tough season and are currently 11th in the Kenyan Premier League (KPL) with a paltry 18 points having played 18 matches.

They parted ways with coach Bernard Mwalala as a result of the poor performance this season and appointed Muhiddin to take charge until the end of the season.

Muhiddin has called for patience and support as he takes over at the Mombasa-based side.

“It is very normal in football to have some bad spell – we call them football cycles, you do well at times and then go for a long period posting bad results. The biggest hurdle now is getting the confidence back in the boys but that is the work of coaches, that is why we are employed so I am happy to play my part,” he said.

“Before Brazil won the World Cup in 1994 they had gone for six consecutive world cups without winning and we all know that Brazil is crazy about football, you can imagine the pressure they were on. But they overcome that bad spell and Bandari too is not any different, we will soon be back where we belong.”

Up next for Bandari is a game against KPL champions Gor Mahia in Nakuru on Saturday afternoon.

Kimani Ngunjiri’s long gun shocks Kenyans – VIDEO

Bahati Member of Parliament Kimani Ngunjiri has left Kenyans fascinated with the length of one of his weapons.

Mr Ngunjiri surrendered his guns to the Director of Criminal Investigation (DCI) Offices on Tuesday morning.

The moved followed a directive by the Inspector-General Hillary Mutyambai saying that the National Police Service (NPS) would no longer provide security to State officers who are involved in crime until they are cleared by the courts.

In addition, such VIPs who are civilian firearm holders will have their licenses cancelled and weapons withdrawn.

According to police, Mr Ngunjiri’s guns were withdrawn because he is under investigation following his remarks regarding Deputy President William Ruto’s ordeal over his official residence in Mombasa.

He claimed that some government officials were frustrating the deputy president and that they had conspired to kick him out of his newly renovated official residence in Mombasa.

But Kenyans appear to be more interested with the hunting rifle he was pictured carrying while walking into the DCI offices in Nakuru.

The rifle is wrapped inside a white cloth but its shape could still be outlined.

The average length of a hunting rifle is 24 inches long. This is what KOT had to say about the size of the gun:

A man charged before Makadara law courts with trafficking bhang is seeking compensation for his household items stolen from his house after police declined to let him lock it.

Mohamed Shaban Kipkemboi is charged with possession of the narcotic herb but wants officers from Kayole police station to pay for the loss of his TV, a gas cylinder and other household items stolen after they whisked him out.

Kipkemboi was allegedly found with bhang valued at Sh 1, 500 in his house on January 15, in Nyando Estate in Embakasi East.

Police officers had been informed by members of the public that Kipkemboi was selling the bhang in his house and after a search, they recovered it and arrested him.

But in court, he told chief magistrate Heston Nyaga that he lost all valuables in his house after the arrest.

Nyaga released him on a cash bail of Sh50, 000 and an alternative bond of Sh 100, 000 and summoned the officer investigating the matter to respond to Kipkemboi’s claims.

Hearing of the case starts on May 5.

How greedy couple lost Sh19m to fraudsters in money multiplication scheme

$

Three fraudsters, who conned a Kirinyaga couple of Sh19.2 million in a money multiplication scheme after compensation by the National Irrigation Board for their parcel of land, are awaiting sentencing after conviction.

The convicted fraudsters are Alexander Miriti Mugambi, Cyrus Mwaura Kamau and Margret Muthoni.

They conned Moses Gitari Kirango and Mary Wambui Njagi of the cash they had received as compensation for their land acquired for construction of a dam.

Muthoni lured her cousin – Mary Wambui Njagi, and her husband Moses Gitari Kirango into the fraud promising to increase their money to Sh 56.1 million at a cost of Sh 1.2 million but they ended up losing the entire payout by NIB in January 2013.

The fraudsters were found guilty of conspiracy to defraud and obtaining money by false pretenses by a Makadara law court and will be sentenced on Thursday.

They were found to have conspired with others to defraud the couple the money by deceit while falsely pretending that they were in a position to multiply the said money to a total of Sh56,100,000 on diverse dates between January and June 2013 at different places in Nairobi and Kiambu Counties.

APPROACHED

Wambui had approached Muthoni for a Sh90,000 loan to take her daughter to university before she was introduced to the money laundering scheme where they were to collude with an alleged official at currency maker De La Rue to get money making chemicals and papers.

“I do find that the intention to defraud was clearly proven and that it was that the accused persons would double the complainant’s money. This amounts to defrauding because only the government has the legal tender to process money,” chief magistrate Heston Nyaga ruled.

“I don’t think that it matters that the scheme itself was illegal from the word go. The accused are the ones who induced the complainants to join the scheme to double (the) money. In their foolishness, for lack of a better word, the complainants fell into the snare – sink, line and hook.”

The fraud started immediately Wambui informed her husband who later met Muthoni and ended after they lost all the cash and the fraudsters stopped picking calls.

Muthoni told Gitari that she had a friend a police officer working at cash making firm Dela Rue, only identified as George.

OFFICER

Muthoni spoke to the said “policeman” who asked for Sh400,000. Gitari had withdrawn the money already and gave it to Muthoni to take it to “officer”.

But the said officer refused to take the money saying the chemicals which were available were worth Sh1.2 million. After two days, Gitari went and withdrew Sh800,000 from Equity Bank Kerugoya and handed it over to Muthoni.

They later went to De La Rue picked the chemicals, and proceeded to the “policeman’s” house to make the money. After making Sh10,000 Gitari was informed that the money was not coming through well.

Gitari was told that the chemical had been contaminated and asked to withdraw a further Sh400,000 for more chemical. He withdrew the money and gave it to the “policeman”. That night, they made Sh 800,000.

The policeman and his friend asked for Sh 100,000 as service fee. Gitari paid them the amount and took the remaining Sh700,000 to bank and was accepted.

He was then asked to provide more money so as to make more profits. He withdrew Sh3 million and gave the amount to Muthoni, the “policeman” and his friend.

This went on until the couple was conned everything. In her defense, Muthoni insinuated a long rooted dispute between her family and the complainants.

But Nyaga said it does not go down to the root issue of whether or not she acted with a common intention with Mugambi and Kamau to defraud the complainants.

10 High school students suspended for having tattoos

A school in Nyeri has suspended 10 students for having tattoos on different parts of their bodies.

The administration of St Mary’s Boys Secondary School suspended the said students after discovering they have artistic drawings on their bodies.

Speaking to NTV, one of the suspended students said the school management said it would only allow them back to school after they remove the tattoos.

“We were suspended from school for having tattoos and told to go home and only return after removing them,” the student said.

He added that he got his tattoo after completing his primary education because he loved art and drawing.

The decision by the school to kick out the students irked parents who called out the administration for being unfair.

A section of them argue that the drawings do not affect the performance of the students, hence the suspension is not justified.

“There is no relationship between tattoos and the performance of the students as they do not affect their brains,” said one of the parents.

However, there are some parents who feel the drawings do not go well with the learning environment and African culture, particularly for young ones.

“It is an idea that has not been embraced by our society and as such, the students must conduct themselves in line with existing regulations and norms,” said one parent.

But according to lawyer Wahome Gikonyo the tattoo industry has no regulations and anyone willing to have it can go ahead to engrave the drawings on his or her body.

“The tattoo industry has a blank cheque and they can do anything to whom they want, whenever they want and to whatever part of the body they want, even a minor may say he wants a tattoo and gets it,” said the lawyer.

Gikonyo, however, noted that despite the blank cheque given to players in the industry, one can still be charged with injuring the body.

The school has refused to comment on the suspension.

Trump to add Tanzania, Nigeria, Sudan to its travel ban list

Tanzania is among seven countries that Donald Trump’s administration plans to add to a group of nations subject to travel restrictions.

Nigeria, Belarus, Eritrea, Kyrgyzstan, Myanmar and Sudan are the countries that the administration has targeted according to Wall Street Journal.

VISITOR VISAS

The new restrictions would apply to travelers and immigrants from said countries and wouldn’t necessarily face blanket bans on travel to the US, but could have restrictions placed on specific types of visas, such as business or visitor visas.

Some countries could be banned from participating in the popular diversity visa lottery program, which awards green cards to people in countries with low levels of immigration to the US.

A White official told media that “not all of the restrictions are uniform,” adding that the proposal limits some immigrant visas from one country and other visas from another.

The plans, which are still under review, are based on interagency input from the departments of Homeland Security and State, as well as the White House, according to the official. President Donald Trump will make the final decision on changes to the ban.

CONTROVERSY

A source told CNN that the administration is focused on immigrant visas because of the difficulty in removing someone from the US who holds a green card or becomes a US citizen if derogatory information surfaces after someone travels to the US.

The administration plans to roll out its expanded travel restrictions on Monday, marking the three-year anniversary of the initial travel ban Trump signed on his seventh day in office, sparking controversy at the beginning of his term.

In the 2018 fiscal year, 24% of Eritreans on business or visitor visas overstayed their permits, along with 15% of Nigerians and 12% of people from Sudan.

Under the current version of the ban, citizens of Iran, Libya, North Korea, Somalia, Syria and Yemen, as well as some Venezuelan officials and their relatives are blocked from obtaining a large range of US immigrant and non-immigrant visas.

Chad was previously covered under the ban but was removed in April 2018.
