
An adopted son of former assistant minister Betty Tett has gone to court seeking to be shown documents that were used to formalise his adoption.
David William Tett, the adopted son of Mrs Tett, wants his foster mother to produce valid legal documents that authorized his adoption from Mama Fatuma Goodwill Children’s Home.
David is the son of Mrs Tett’s cousin. His mother died when he was one year-old.
DEATH SENTENCE
Last year, he was sentenced to death for robbing his foster father at gunpoint in their Karen home. The court found him guilty of being part of a gang that violently robbed Mr William Mulready Tett, on September 6, 2011.
In his petition to the court on Wednesday, David alleged that he is dissatisfied with the way Mrs Tett and her husband treated him “ by framing him so that he can be imprisoned for an offence he alleges did not commit.”
He also wants the British High Commissioner to be present in court during the hearing of his petition to explain the adoption of his biological sister in United Kingdom by a relative of Mr Tett.
APPEAL
David also urged the high court to appoint a lawyer to prosecute his appeal against the death sentence.
He asked Justice Luka Kimaru to direct the deputy registrar of the high court criminal division to appoint a lawyer at “ the state’s expense” to present his appeal.
He alleged that all lawyers he has engaged have been compromised and “ now stands to suffer prejudice since he cannot be represented by an advocate of his choice.”
During the trial of the violent robbery case he was defended by lawyer John Swaka “ who has since ceased acting for him.”
